These general terms and conditions of sale, hereinafter referred to as GTC, apply to current and future commercial relations concluded between Yam Nutrition Suisse Sàrl (hereinafter “ Yam Nutrition Switzerland ”) and its client (hereinafter “ the customer ").

They prevail over all general or specific conditions of the customer.

Is considered as " customer » any natural or legal person who accesses the Yam Nutrition Suisse online store and/or places an order privately or as part of a commercial activity.

Any person placing an order on the Yam Nutrition Suisse website declares that they are over 18 years of age and have the legal capacity or, failing that, the authorization of their legal representative to do so.

Any person placing an order on behalf of a third party (legal or natural person) declares that they have the necessary powers of representation.

The presentation of products in the Yam Nutrition Switzerland online shop does not constitute an offer to conclude a contract. In particular, the presentation is subject to product availability. Based on the product presentation, the customer is making a purchase offer to Yam Nutrition Switzerland.

When the customer chooses one or more products, they are placed in the virtual shopping cart. The customer can consult his virtual shopping cart at any time and see the selected products. He can freely modify or delete the selected products. When he clicks on the button " At the checkout ", the customer must provide all the information necessary for shipping and choose a payment method. Before the order is completed and validated, all information relating to the order is displayed. By clicking on the " Buy now” the customer completes the order process.

By sending the order, the customer agrees to these conditions of sale.

Yam Nutrition Suisse acknowledges receipt of the order by sending an email. This order acknowledgment does not yet constitute acceptance of the customer's purchase offer. The declaration of acceptance of the purchase offer only takes effect within 48 hours through delivery of the products or a declaration of acceptance.

The price applicable to orders is the price indicated in Swiss francs (CHF) when ordering.

Delivery costs are charged in addition according to the applicable Swiss Post rates if the customer chooses this option (shipping costs).

By ordering the product, the customer can have it delivered to Switzerland exclusively.

Delivery costs are the responsibility of the customer.

Payment for orders is made by credit card at the time of ordering. The account associated with the customer's credit card is debited immediately after the order is placed.

The customer has the possibility to return the ordered products within 14 days from delivery with the right to a full refund of the purchase price excluding shipping costs. Return of the goods is the responsibility of the customer.

The right to reimbursement is extinguished if the product has been opened or damaged by the customer.

The customer must immediately notify Yam Nutrition Suisse of any defect in the products.

Any warranty from Yam Nutrition Switzerland is excluded except for the mandatory provisions of Swiss law.

It is the customer's responsibility to inquire about any possible food intolerances.

Yam Nutrition Suisse processes the customer's personal data in connection with orders and does not share this data with third parties except the carrier or delivery partner. Yam Nutrition Suisse may use the customer's personal data for product promotion. The customer may request the deletion or modification of their personal data at any time.

However, Yam Nutrition Suisse cannot be held responsible for delivery times of items ordered and delivered by mail or for any possible deterioration during transport or storage with a partner.

Yam Nutrition Suisse cannot guarantee the absence of any disruption in the operation of the site and its various features. Consequently, Yam Nutrition Suisse declines all liability for any direct or indirect damage related to access to or use of the site or some of its features (breakdowns or interruptions, network overload, access interrupted or made impossible by network operators, etc.).

Yam Nutrition Suisse reserves the right to modify these General Terms and Conditions at any time. The new General Terms and Conditions are published on the Yam Nutrition Suisse website. All orders remain governed by the general terms and conditions applicable on the date of the order.

Swiss law alone applies to orders.

In the event of a dispute, the legal venue is Lausanne (VD).
